General conditions for actors

General
Article 1 definitions

1.1 "Actor" in these general conditions means anyone who participates in a performance as an actor or voice actor on the proposal of Groen Casting.
1.2 "Performance" shall in any case mean: acting, making music, dancing for a theatrical performance, sound, video or film recording, in front of an audience or promotional activities.
1.3 Groen Casting reserves the right at all times to refuse people who have applied without giving any reason.

Article 2 Applicability

2.1 By registering with Groen Casting, the actor agrees that these general conditions are applicable to all activities of Groen Casting for actor mentioned in these general conditions and all resulting assignments for actor.
2.2 Terms and conditions used by the actor that deviate from these general conditions shall never apply to the relationship with Groen Casting or clients of Groen Casting unless explicitly agreed otherwise in writing.
2.3 The financial settlement of the services of the actor is the responsibility of the clients of Groen Casting. For this purpose, Groen Casting shall transfer data of the actor to the client. Groen Casting is never and under no circumstances responsible for the financial settlement of the services of the actor.

Article 3 authorisation

3.1 By registering with Groen Casting, the actor has authorised Groen Casting to introduce the actor to clients for participation in acting.
3.2 Groen Casting may propose but may in no way commit an actor to a performance without actor's consent.

Article 4 Acceptance of orders and agreements for (extra) use

4.1 If an actor is chosen for a role and agrees verbally or in writing to a performance offer presented by Groen Casting, a commission contract is created between the actor and the client named by Groen Casting. The actor therefore commits himself, not only to Groen Casting, but also to the client named by Groen Casting, to carry out the performance at the time, place, manner and any financial arrangements as agreed.
4.2 If nothing has been further specified, each contract for a performance shall be deemed to include an agreement for user rights, in which all user rights and, as far as possible, all other copyright rights in the broadest sense shall be transferred to the client.

Obligations of actor towards client

Article 5 Correct and complete execution of the order

5.1 The actor is obliged to execute the order in full as agreed, i.e. for the entire duration of the performance.
5.2 Groen Casting shall never become the client or employer of an actor, nor can Groen Casting ever be held liable for negligence or non-fulfilment on the part of clients. No other legal relationship arises between actor and Groen Casting by acceptance of an assignment by actor than the one governed by these general conditions.
5.3 If the actor fails to comply with the agreement with the client, whether or not through the intermediary of Groen Casting, or fails to comply adequately, or speaks negatively about the client, Groen Casting shall not be liable for any damage that the client may suffer as a result, except in the event of gross negligence or intent.
5.4 Actors undertake to be insured during the (agreed) work. Actors also undertake to be insured for medical expenses during the work and, if necessary, to take out travel insurance.
5.5 Groen Casting is not liable either to actors, the client or third parties for accidents, disability or death on the way to and/or from the location of the shoot and during the shoot.

Article 6 personal data

6.1 Personal data provided by the actor and/or image recordings made by Groen Casting become the property of Groen Casting upon registration. Groen Casting obtains the right of use.
6.2 Groen Casting is entitled to make personal data and images of the talent available to third parties (possible clients for the actor).

FINAL PROVISION
Article 7 Applicable law

7.1 All disputes arising from or related to the activities performed by Groen Casting under these general terms and conditions shall be judged according to Dutch law and shall, except where otherwise provided by mandatory law, be exclusively settled by the competent court in Amsterdam.
